The History of U.S. Military Veterans and Mesothelioma

Currently, there are twenty-five (25) million people existing who have served in the military at one point in their lives, as is stated by the United States Department of Veterans Affairs (VA). It is also estimated that among these 25 million military veterans, possibly millions of these remaining veterans were exposed to deadly asbestos substances. Asbestos was commonly used in every branch of the armed forces, due to its’ fireproof ability and its’ capability to resist heat. Asbestos was held in such high importance that it was permitted for common use until it was later slowly replaced and use of the use of asbestos materials were finally completely brought to an end in the 1970’s.An astounding 300 or more products contained asbestos-related materials, mostly found in insulation, were applied and used, mainly by the U.S. Navy beginning in the 1930’s until the 1970’s.

These asbestos-related products were widely used in boiler rooms and engine rooms, along with other ‘below-deck’ areas, for fireproofing reasons. Although all navy personnel who worked on-board navel ships between the 30’s -70’s are at risk for asbestos-related cancers, mesothelioma, those veterans whose jobs required them to be below-deck, such as those who worked in the boiler or engine rooms, and even in the sleeping quarters, were more profoundly exposed to asbestos and are at a much higher risk for mesothelioma.

A much more profoundly telling statistic shows that of those surviving American veterans who are now suffering from mesothelioma, those who were exposed to asbestos or asbestos-related materials during their active military service exceeded 30% of the military population.

Asbestos-Related Illness and American Veterans

Those veterans who are currently living with illnesses that is asbestos-related (illnesses created specifically by exposure to asbestos or other materials containing asbestos fibers); These ill and suffering veterans find themselves in a complex complicated situation with little to no compensation provided by the U.S. Government. While it is forbidden for the veteran to attempt to obtain any form of compensation (i.e. lawsuit) against the U.S. government through the current judicial system. Veterans who are experiencing asbestos-related illnesses must apply at the VA office for veteran benefits. The process will begin with submitting n application at a Veterans affairs office, from the time of application it could be a long and hard battle to receive medical benefits or any type of disability compensation. Furthermore, the patients claim may be immediately denied because it is the responsibility of the patient to prove that their illness is, indeed, due to their exposure to asbestos during their military service. If the veteran is unable to prove their exposure to asbestos resulted from their time in service, they must seek compensation through the asbestos manufacturers. The VA accepts mesothelioma as a service related illness but the VA may deny their claim for medical disability, unless the veteran can prove that their mesothelioma was probably not a result of their time in service.

Mesothelioma: An Overview and Legal Guide

What is mesothelioma?

As we have continued to talk about throughout this website, Mesothelioma is a type of cancer caused by exposure to asbestos on a regularly, particularly in the workplace between the 1930’s and 1970’s. Mesothelioma can take several decades to form, generally several decades. Consequently, people that worked with asbestos, unknowingly, conceivably 30-40 years ago are only currently being diagnosed with this fatal disease. Mesothelioma cancers can have an effect on a number of critical organs: the most common form being Pleural Mesothelioma; which affects the lungs. Pleural Mesothelioma causes fluid increase and development which causes a variety of symptoms such as breathing complications; including shortness of breath, constant coughing and swallowing difficulty; the second type, Peritoneal Mesothelioma, has an affect on the stomach and the abdominal area, causing severe symptoms, such as, vomiting and nausea, bowel obstruction all resulting in loss of appetite; and the most rare type, Pericardial Mesothelioma, affects the heart and can cause palpitations, constant coughing and some chest pain. Conversely, due to the fact that mesothelioma takes several decades to develop the initial symptoms may come several years, even decades, after the exposure that can cause mesothelioma.

Quite a number of employers and manufacturers were well aware of the dangers of asbestos exposure, yet continued to permit their employees to continue working, unprotected, in close contact with the asbestos. Now that theses effects of the intentional exposure are appearing, these firms are being forced to compensate the sufferers who have been given this ‘death sentence’ and are suffering from the pain and misery mesothelioma causes to them and to their loved ones. And due to so many cases of mesothelioma now becoming common, many lawyers and law firms have begun to specialize explicitly in mesothelioma cases to fight for the victims and their families the payment they deserve and have the right to fight for through the legal process.

Legal Guide

It is that it is critical to find a mesothelioma lawyer, for representation, as soon as you can after the initial diagnosis of mesothelioma, due to state by state statutes of limitations (time limits) that you have to file your claim. Missing the statue of limitation could cause you to be considered to be ineligible for action. Failing to meet the statute of limitations could cause you the loss of a huge compensation award, which could help you and your family make it through this hard time.

After you have gotten a lawyer, an appointment will be made to talk about the case in greater detail. The lawyer will need to put together a solid case. Putting together this case will take a bit of time, and in order to bring the case to the court system, you will need to provide the lawyer with as much information and evidence as you possibly can. Investigation will take additional time. So, to not miss the deadline of the state, filing the claim as soon as possible is critical.

Mesothelioma Settlements

With many mesothelioma cases surfacing each year, more people are coming forward to make their own claims for compensation. As the amount of victims of mesothelioma increases, the number of law firms and lawyers that represent and focus on mesothelioma settlements also increases.
Lawyer firms and the attorneys that represent mesothelioma claims should not to be mistaken for the large amount of “no claim, no fee” personal injury lawyers that have increased in recent years. Mesothelioma attorneys concentrate and specialize exclusively in mesothelioma claims and work hard to recover the highest possible amount for the victim or the victims’ family. Their sole purpose is to force those irresponsible companies to compensate for the damages their negligence has caused the family and victim endures.
Outcomes of the lawsuits will vary, and settlement amounts have differed immensely Some claims have resulted in only hundreds of thousands of dollars in compensation, while others have settled on multi-millions. Because so many cases have settled in the millions of dollars range, new rules have been set. Victims can expect that their medical expenses will be paid for but also their family members will be financially secure after the victim passes away.
Mesothelioma victims are well within their rights to file a claim for financial compensation for pain, suffering and mental anguish, as are their family within their rights to file for wrongful death and the pain and suffering they have had to bear as their loved one passes away quickly (usually within 4 to 24 months) Claims can be filed even after the victim has died. The family maintains the right to be compensated for the unnecessary death of their loved ones.
Most mesothelioma attorneys recognize a strong case when they see it and know there will be a large compensation from this lawsuit and for this reason most will not take any retaining fees or other fees upfront. This is known as working on a ‘contingency basis’. Essentially, the lawyer will work for free, even covering the fees of investigators. Working on a ‘contingency basis’ means the lawyer will be paid after you win your case and collect your compensation. The lawyers’ fees are, on average, 35% of the compensation amount.
The time limit, known as the statute of limitations, varies by state, but is generally limited to one to two years after initial diagnosis. Speak with a lawyer regarding the deadline. If the deadline has been missed, it is possible the lawyer can find something that can be done still.

If you miss the time limit deadline for filing your claim, it is always a good idea to talk with an attorney anyway. The lawyer can inform you if there is anything at all that can be done, regardless of the missed deadline. A missed time limit will typically make your chances of a successful claim be low. But the best advice will come from your attorney, who will check all of the details and information properly to find any loopholes.
Those patients or their family members, who are searching for a lawyer to represent them in a lawsuit, should search for a lawyer who has proven record and exceptional experience in handling mesothelioma cases. An expert in the field of winning mesothelioma compensation claims will not hesitate to provide you with the number of cases he has represented in mesothelioma cases along with how many cases he/she has won or lost. Due to confidentiality laws, the lawyer can not give anyones name or provide any elaborate details involving previous cases. But they can provide amounts and types of compensation awarded and how much time the case took.

Today there are several lawyers specializing in mesothelioma and people that have been affected by asbestos exposure, shouldn’t find it hard to locate a local attorney for representation, one with experience and a proven history of not only experience in handling mesothelioma compensation claims, but winning them. Requesting more information (facts and figures) to show proof of several lawyers’ history in mesothelioma cases, will allow you to chose the lawyer who can successfully resolve your case quickly and with the best amount of compensation possible.

Mesothelioma Litigation

Patients who have been recently diagnosed with mesothelioma deserve and are well within their rights to file a claim for compensation. Many of the firms who are responsible for exposing their employees to asbestos, did so, knowing the dangers of this exposure, yet still permitted the employees to continue work, with no or no protection from this asbestos exposure. Now, just when many of these employees are preparing for retirement, asbestos exposure is taking a toll on their health, many years after the initial exposure. And, though compensation could never completely compensate the patient and their loved ones for the pain and suffering and the loss that the asbestos exposure is now causing them, compensation is, to say the very least, some type of justice.

Most states set a time limit, called ‘statute of limitations’ in which a lawsuit can be filed and a claim can be made, so it is crucial that you chose an attorney and file your claim before the courts deem you as ineligible for any compensation.

Product Liability:
If you have been contracted mesothelioma from exposure to asbestos from a faulty product, and have ingested asbestos fibers by using this product, your claim should be made as product liability. This results in compensation from the product manufacturer.

Professional Malpractice:
Professional malpractice is a difficult area to prove, because mesothelioma symptoms are non-specific and because the disease lays dormant for decades, it is most often at the end stages of cancer before a person will seek medical help and be properly diagnosed. Additionally, symptoms are not specific, meaning that the symptoms could be related to another illness and if your doctor has no knowledge of your asbestos exposure, it is likely that the doctor will test and treat other illnesses before testing for mesothelioma. In order to avoid a misdiagnosis make sure your doctor is aware of any asbestos exposure that you may have been involved in. This gives the doctor a chance to diagnose accurately and recommend early treatment. There have been cases of medical negligence in the case of mesothelioma compensation that have won.

Worker Compensation:
When you have been exposed to asbestos and been diagnosed with mesothelioma from unprotection in the workplace from the asbestos, you are eligible to file a workers compensation claim. Many employees now at the age of retirement, or nearing retirement, have worked with asbestos some decades ago. Military veterans are particularly at risk. The company was irresponsible then, but can now be held responsible for the claim, even if the company has filed bankruptcy. Specific federal regulations were created so that the victim may still file a lawsuit to be compensated.
Wrongful Death:
The compensation that mesothelioma victims have the right to claim is wrongful death action to cover this pain, suffering and mental anguish, as well as to cover the large amount of medical expenses which can be extreme. The average survival time for a patient with malignant mesothelioma is from four to twenty-four months, which means the family may not only have to cope with the shocking news of this fatal disease but also cope with the loss of their loved one soon after hearing the news that they have this disease. This is another cause for the compensation claim; to secure the family after their loved one has been taken away from them.

Mesothelioma and the Law

Recently, there have been multi-million dollar payments for compensation to the victims of mesothelioma, from asbestos-related causes. This cancer is fairly new to both legal and medical professionals, although the asbestos exposure has typically occurred several decades ago. The diseases are appearing many years after initial exposure. Victims of mesothelioma and their loved ones have the right to and deserve for the companies and manufacturers to be responsible for this fatal disease and to be compensated for their pain and suffering, as well as the victims family deserves the right to be compensated for the loss of their family member. To assist the victims to practice their rights to file a claim against these companies and manufacturers, numerous attorneys and complete law firms have been educated and created to represent mesothelioma claims to get mesothelioma victims and their family members the compensation to which they deserve and have the right to collect.

Why do mesothelioma patients have the right to be compensated?

Most cancers are not the responsibility of an outside party. Most cancers are the result of something the person ‘chose’ to do, knowing the dangers, such as smokers. Meanwhile there are other cancers, still, like breast cancers, cervical cancers and prostate cancers which are no ones fault at all. Early detection can result in early treatment of these cancers and prevent fatalities from these cancers. The cancer will develop in the workers bodies, but remain dormant for several decades and by the time appropriate diagnosis and tests are conducted, it will be too late and the victim will only have a very short time left to live. The remainder of time could be from 4 months up to 24 months.

Mesothelioma is completely different. Mesothelioma is a cancer that could have been avoided, and is the fault of others. The companies, who knew the dangers of asbestos, knew of its presence in the work place but made no attempt to protect the employees, are held responsible.

Mesothelioma lawyers help victims of mesothelioma to be appropriately compensated from these irresponsible companies for pain and suffering and for their ultimate fate. The compensation will be needed to pay for medical expenses and pain and suffering. But the compensation will also, in the end, help the family of the mesothelioma victims’ family to be financial secure after they are gone.

The payouts for compensation of mesothelioma have been huge amounts from hundreds of thousands to millions of dollars, but to be sure that the victim and their families get appropriate compensation, they will need to consult with an attorney as soon as possible following diagnosis, to ensure that the claim is filed before the statute of limitations (time limit) has not expired. Keep in mind, also, that your lawyer will need an ample amount of time to put the case together and complete any necessary research, as well. Time is the most important element in a mesothelioma case. Just a few days of delaying to provide information or to obtain legal help could make the difference between financial security and no receiving compensation at all.

Most victims and their families may have big concerns about medical expenses and then adding legal costs. Most attorneys representing mesothelioma cases are aware of the big payout of a lawsuit against irresponsible companies and asbestos manufacturers. For that reason alone, many lawyers are willing to take the risk and work free (contingency basis) until your case is resolved and you are compensate. They will receive their fees (typically 35% of the final payout) after you have received your compensation. If they fail to win your case, they will take no legal fees at all. Medical expenses can also be covered by the compensation, which is generally a large amount, minimum 6 figures.

An experienced mesothelioma attorney has created a large group of important contacts, in order to provide his clients with an appropriate support network, from support groups to investigators and others in the field of mesothelioma support.

Making the Mesothelioma Claim

Most of the victims or their family members are unclear of the process of filing a claim. The process of fling a claim is fairly simple, but due to state statute of limitations (time limits) for personal injury and wrongful death, In most states the statutes are set at only one to two years, some allow up to four years for a personal injury claim. So, filing as soon as possible after the mesothelioma diagnosis is confirmed is crucial, in order to be compensated accordingly. Failure to do so can result in a dismissal of the case and denial of any compensation.
The same statutes pertains to family members who are filing a claim seeking compensation for wrongful death of a loved one along with those who were affected by close contact with the deceased family member who had died of exposure to asbestos and now these family members have contracted asbestos-related illnesses.
The first step in the process of filing a claim is to hire a good mesothelioma attorney. Search for a lawyer who has no hesitancy to present the facts and figures regarding previous mesothelioma cases they have represented. The attorney should have a positive history of winning mesothelioma cases; this will show that the attorney already has the necessary contacts available to help win your case, such as investigators, etc. An appropriately experienced attorney will also have the contacts to provide you with further resources, such as support groups.
Most victims and their families will worry about the cost of hiring such an attorney, but to tell the truth, most mesothelioma, personal injury and wrongful death attorneys will work on a contingency based fee. What this means to you is you will pay nothing for legal fees, unless you win. The attorney will be paid from the compensation you or your family receives.(The average is 35% of the final award) If you lose your case, or if it is dismissed, the attorney will be paid nothing. So, specifically search for an attorney who will work on a contingency basis, if legal fees are a concern to you. Even after the attorney is paid their 35%, these types o cases typically compensate with a 6 to 7 figure award, a large amount still remains for you and your loved ones.
After you have located a lawyer who has satisfied your requirements for their fees and experience, you will need to go over the details of the case with them. You will need to be completely honest and hide nothing from your new attorney. They will need to know your current condition, who diagnosed mesothelioma, if it can be treated or if it has been declared terminal. You will also be required to tell him where and when you were exposed to the asbestos. If you are not clear or unsure about any details, don’t worry. A good mesothelioma attorney will have investigators who can do research and uncover this information. This investigator will be paid by the attorney.
Then, with the details you provide, the attorney can determine if the case is worth going after and exactly which type of claim should be filed. The choices are limited and the attorney can determine which claim, against the company, the manufacturers, the insurance companies, will give the best compensation in the end.
Finding a good attorney is much easier today, with TV advertisements, internet advertisements, and local phone books. Levels of experience differ from lawyer to lawyer, as do their fees. The most crucial things to look for when choosing an attorney to represent you are the attorney (or law firms) experience in mesothelioma cases, if the lawyer works on a contingency basis or not, and if they are willing to provide the facts and figures (without disclosing confidential information) of previous mesothelioma cases that they have represented. The attorney should also be very upfront and frank about the percentage of the percentage of fees he will receive after you are compensated.

Compensation for Mesothelioma

Today, an astounding amount of claims are being filed within the court systems against the responsible firms and industries, for previous asbestos exposure, as the cases of Mesothelioma are on the rise. As a result, there are also an increasing number of lawyers who specialize particularly in mesothelioma lawsuits. Compensation awards will naturally be different from case to case, based on the variety of circumstances. However, it is the mesothelioma lawyers’ job to make these neglectful firms compensate the victims for the personal injury of this fatal disease or to pay the family members of the deceased victim, for wrongful death. Basically, it is the responsibility of the mesothelioma lawyer representing the family or the victim to ensure that the company is held responsible for the asbestos exposure and its’ effects on the workers and their family.
Most of the victims or their family members are unclear of the process of filing a claim. The process of fling a claim is fairly simple, but due to state statute of limitations (time limits) for personal injury and wrongful death.

Asbestos Exposure

While statistics have revealed that an increasing number of people who have never before worked with asbestos or asbestos materials many people are afflicted with illnesses that are asbestos-related. Most of the cases that have been documented of these illnesses or diseases are a result of occupational exposure. This is because of the possibility of repeated exposure, which happens as a result of normal operations in many industries.

Jobsites

As you would expect, work places like that of processing plants, asbestos mines, manufacturing plants and any other place where asbestos products and materials were developed, are well known for having high occupational exposure. But, many other work places (shipyards, automobile manufacturing factories, oil processing plants, power plants, and chemical factories, for example) also maintain a high record of asbestos exposure, too. People who previously worked in these areas, especially in the early 1900’s, were almost certainly exposed to asbestos or asbestos-related materials and products and are at greater risk of developing mesothelioma.

Occupations

Specific jobs result in a more high risk of asbestos exposure. Many workers, in various fields, did come in contact with asbestos, because many, both industrial and domestic, products contained asbestos materials.

Because asbestos was incorporated into many electrical and plumbing products , plumbers and electricians have a high chance of having an asbestos-related disease.

Jobs with a high Risk Of Asbestos Exposure

Automotive Mechanics – frequently used for brake pads, clutch assemblies and other automotive parts.

Coast Guard and Navy – Asbestos was regularly present on ships from the 1930’s until the 1970’s.

Construction- to include the following occupations.
Demolition
Steamfitters
Steel and Iron Workers

Chemical Plants – used as a filter within chemical plants, often.

Electricians - Asbestos was commonly used as insulation for wiring

Factories – Factory workers who created, developed or packaged asbestos-related materials

Merchant Marine – Asbestos was often used aboard ships in bunk and deck areas for fireproofing purposes.

Power Plants – Workers in power plants may have been exposed to asbestos materials as it was used for fireproofing purposes.

Shipyards – at risk to exposure would be workers who removed or those who installed asbestos in ships or on ship parts.

Asbestos & the Military

Primarily used for insulation reasons in vehicles, buildings and aircraft, asbestos-related materials were commonly used throughout every branch o the US military, particularly in the Navy and Coast Guard. The Navy used asbestos materials in hundreds of different ways within their shipyards and ships, throughout the 1930’s until the 1970’s. Thousands of Navy veterans and shipyard personnel were on board ships and were highly exposed to asbestos. Due to the small areas they worked in, without proper ventilation, their exposure to asbestos materials causes them a much higher risk of developing asbestos related illnesses or diseases. World War II also created a higher demand for necessary supplies. The high demand caused a large increase of manufacturing of asbestos products and materials throughout shipyards.

Accidental Exposure

Most records of asbestos exposure occur from certain workplaces, but accidental exposure has become a way in which people contract asbestos-related illnesses and diseases.

One such example of accidental exposure occurred on 9/11/2001 when the World Trade Center buildings were attacked. A projected 2,000 tons of asbestos filled the air in the huge dust cloud that formed as the buildings fell. A shocking 62% of those people, who were trapped in the dust cloud, trying to escape, are now coping with serious respiratory illnesses, as reported by a the Center for Disease Control in 2006.Another example occurred from the most expensive natural disaster in US history, hurricane Katrina in 2004. The storm damaged or destroyed many older homes, which were contaminated with asbestos. Some of these homes are still intact today. This area continues to restore and rebuild structures, while preventing asbestos exposure.

Compensation for Mesothelioma

Why are mesothelioma victims entitled to compensation?

But the compensation will also, in the end, help the family of the mesothelioma victims’ family to be financial secure after they have passed away.

This is shocking news for both the victim and his/her family.

The compensation that mesothelioma victims have the right to claim is to cover this pain, suffering and mental anguish, as well as to cover the large amount of medical expenses which can be extreme.

How mesothelioma claims are made and settled?

Asbestos Lawyer/Attorney

Since the 1970’s, Mesothelioma cancers have been increasing and as the amount of people diagnosed with mesothelioma increase, so does the amount of lawsuits against asbestos manufacturers and other big businesses. With this huge rise in lawsuits, due to the increase of mesothelioma patients seeking compensation, lawyers specializing in mesothelioma cases have now come to be necessary. Lawyers who explicitly represent mesothelioma patients and their families have the ability to collect a large amount, often millions of dollars, in compensation for the victim and their family.

Most states set a time limit, called ‘statute of limitations’ in which a lawsuit can be filed and a claim can be made, so it is crucial that you chose an attorney and file your claim before the courts deem you as ineligible for any compensation.

Because there is no way to say exactly how your case will go or how much compensation you could receive or how long your case will take to be settled, it is important that you understand, your lawyer can not give you the answers to every question you may have in only one day. As the case proceeds, your attorney may be able to somewhat predict what the outcome may be, as developments occur.
To help move your case a little faster, it will be helpful if you provide your attorney with as much details and information as possible, as far as the exposure to asbestos is concerned. Be honest and open with your attorney, hiding nothing. If needed, your lawyer can hire an investigator to provide further evidence on your exposure to asbestos. Most attorneys for mesothelioma compensation cases work on a contingency fee, meaning that they will not expect any payment until you have won your case and been compensated and they will take no money if you do not win your case.
